Terms of Service

These terms describe the rules for using Wabitat’s hospitality commerce, account, partner, and delivery services. Additional order-specific information shown at checkout also applies to that order.

1. Operator and agreement

Wabitat is the service brand for a hospitality commerce and delivery platform serving Portugal. Questions about these terms and official notices can be sent to {contactEmail}.

By using the service, placing an order, or creating an account, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the relevant service.

2. What Wabitat provides

Wabitat connects hospitality properties and guests with practical, lower-waste essentials and operational delivery services across Portugal. The available service depends on the property, region, stock, and delivery capacity.

  • Guests may order curated packs and individual add-on products for delivery to an eligible accommodation or another allowed delivery address.
  • Hosts may request partner onboarding, manage property information, and access commercial or operational workflows made available to them.
  • Packs are bundles of physical products. Product descriptions, images, availability, and pack contents may change when stock or suppliers change.

3. Accounts and security

Some host and account workflows require accurate registration information. You are responsible for keeping your credentials confidential and for activity carried out through your account.

You must promptly tell us if you suspect unauthorised access. We may suspend or deactivate an account when necessary for security, legal compliance, non-payment, or a breach of these terms.

4. Products, prices, and availability

Prices and delivery fees are shown in the checkout flow before submission. The service uses EUR unless the checkout states otherwise. We may correct obvious pricing or description errors and will communicate the effect on an affected order.

  • A guest checkout must contain at least one pack; individual products may be added as add-ons.
  • Stock, pack composition, product availability, and delivery capacity are subject to operational limits.
  • Product images and descriptions are provided to identify the product and may not reproduce every packaging or supplier variation.
  • You must follow product instructions and any safety, storage, allergy, or use information supplied with the product.

5. Orders and acceptance

When you submit checkout information, we create an order record and begin the requested payment or fulfilment workflow. An order is subject to stock, address, delivery capacity, payment, and other validation checks.

The order confirmation, payment status, delivery information, and any specific policy shown at checkout form part of the order record. If we cannot fulfil an order, we will notify you and apply the refund or cancellation rights required by law and the applicable order policy.

6. Delivery

You must provide a complete and accurate accommodation, address, contact number, and delivery information. Guests choose preferred dates and one-hour slots where available; Wabitat confirms the final slot after route planning.

  • Delivery availability depends on the selected region, date, route capacity, and the operating hours shown at checkout.
  • The person receiving the order should be available at the confirmed accommodation during the confirmed slot.
  • If delivery cannot be completed because the information is inaccurate or nobody is available, the order may be rescheduled, returned, or cancelled under the delivery policy shown at checkout and applicable law.
  • A new delivery fee or refund adjustment may apply only where the applicable delivery policy clearly says so and the law permits it.
  • Wabitat may use hosts and assigned drivers to coordinate and complete delivery. They receive only the information needed for the delivery workflow.

7. Payment

The available payment methods are shown at checkout and may include card payment through Stripe and payment on delivery, such as cash or Revolut. A payment provider may apply its own terms and privacy notice.

A card order may remain pending until the payment provider confirms payment. We may cancel or pause fulfilment if payment fails, is reversed, or cannot be verified.

8. Cancellation, refunds, and returns

Cancellation and refund options depend on the order status, the delivery policy shown at checkout, the product characteristics, and mandatory consumer law. Contact Wabitat promptly if you need to cancel or report a problem.

Because some items may be consumable, perishable, sealed for hygiene, or prepared for a specific delivery, statutory withdrawal exceptions may apply where permitted by law. Nothing in these terms removes mandatory rights or legal guarantees.

9. Consumer rights and product conformity

If you are a consumer, you retain the mandatory rights that apply to products and services under the law governing your order, including applicable conformity, defect, safety, and complaint rights.

Please contact Wabitat with photographs or relevant order details when reporting a damaged, incorrect, unsafe, or non-conforming product so that we can investigate and provide the remedy required by law.

10. Hosts and partner workflows

A partner inquiry is an expression of interest, not a binding host agreement. A host partnership begins only when the parties agree separate commercial terms or Wabitat confirms onboarding under the applicable workflow.

  • Hosts must provide accurate property, contact, access, storage, and payout information and keep it current.
  • A property-attributed guest order may generate a commission under the commercial rules and property settings applicable to that order; B2B pack purchases are separate from guest commission calculations.
  • Hosts must use guest and order information only for the agreed hospitality and delivery purposes and must protect it from unauthorised access.

11. Reusable packaging

Where a reuse or recovery programme is offered, customers should keep designated packaging, bottles, or containers available for collection as described in the service. Recovery depends on operational availability and does not change mandatory product or consumer rights.

12. Intellectual property

Wabitat and its licensors retain rights in the website, software, brand, text, images, design, and other service materials. You may use the service for its intended personal or business purpose, but may not copy, scrape, reverse engineer, resell, or misuse those materials without permission or a legal right to do so.

13. Liability and service changes

We will provide the service with reasonable care and skill and will remain responsible for liabilities that cannot lawfully be excluded or limited. To the extent permitted by law, we are not responsible for delays or failures caused by events outside our reasonable control, inaccurate information supplied by a user, or misuse of a product or service.

We may change, pause, or discontinue a feature, catalog item, route, or partner workflow for operational, safety, legal, or security reasons. Changes do not remove rights already accrued under an accepted order.

14. Privacy

Personal data is handled as described in the Wabitat Privacy Policy. The policy explains the data collected for accounts, orders, deliveries, payments, QR visits, support, security, and partner operations.

15. Changes, law, and contact

We may update these terms when the service or legal requirements change. The current version is identified above. If a change requires renewed agreement, the service will ask you to accept the new version before the affected account or order workflow continues.

Mandatory consumer protections and the law and courts applicable to the order will apply. For questions about these terms or an order, contact general@wabitatservices.com.
